Personal Estate Planning:
- Wills are documents which take place on death.
Making a Will is the only way to ensure that your wishes in relation to the distribution of your personal property are adhered to when you die.
Without a will your property will distributed in accordance with Law of Intestacy which may be not what you had wanted.
- Powers of Attorney are documents which take place during your lifetime.
A Property and Affairs or Personal Welfare Lasting Power of Attorney (LPA) allows you to plan ahead by choosing one or more people you trust to make decisions and take appropriate actions on your behalf regarding your property and financial affairs or matters concerning health and welfare decisions.
If you lose capacity in the future and do not have a power of attorney in place it may be necessary for an individual to apply to the Court of Protection to make decisions on your behalf, which is a lengthy and sometimes costly process.
